Acknowledgement, Assumption of Risk, Consent and Indemnity

I will be participating in travel services organized by EARTHSTOMPERS ADVENTURES CC (Business Registration: 2005/165606/23 ) and/or EARTHSTOMPERS LUXURY TRAVEL AND SAFARIS PTY (Business Registration: 2014/034686/07), hereinafter referred to as Earthstompers.  I am prepared to give certain warranties, indemnities and consents and make certain acknowledgments relating to my participation and behavior whist using Earthstompers’ travel services. It is a condition of my participation in the services that the said warranties, indemnities, acknowledgments and consents be recorded in writing and acknowledged by myself.  By booking travel services, I acknowledge and agree to the following:

1. I am 18 years of age or older (or that I am consenting to the below terms on behalf of my minor child/ward).
2. I have permission from the other members in my traveling party to book travel services and consent to these terms on their behalf.
3. I acknowledge that I am aware that the activities organized and conducted by Earthstompers in which I will be participating can be dangerous and can result in personal injury including fatal injury to myself or my child/ward. I confirm that I fully appreciate the nature of the risks that I will be exposed to whilst participating in the I hereby voluntarily assume all risks that are associated with the activities and consent to the risk of any harm that may befall me whilst participating in such activities including bodily injury and death.
4. I agree that I shall have no claim of whatsoever nature against the owners, shareholders, directors, members, employees, guides, representatives, agents, suppliers, or other persons contracted to Earthstompers Adventures CC or Earthstompers Luxury Travel and Safaris PTY for any injury, harm or loss of whatsoever nature which I may suffer whilst participating in the activities even if such injury, harm or loss is caused by the negligence of any of the above parties or co-participants. I accordingly indemnify all the parties against any injury, harm or loss that I may suffer whilst participating in the services.
5. In addition to the exemption from liability detailed above, I further agree that none of the parties shall be liable to me for any injury, harm or loss of whatsoever nature suffered by me at any time during the services (and not only whilst participating in the activities) arising from any cause whatsoever including but not limited to illness, accident, theft of personal belongings, injury or This exemption from liability shall apply even where the injury, harm or loss referred to above is caused by the negligence of any of the parties.
6. I hereby warrant my obedience to instructions and rules given by an authorized person whilst using Earthstompers’ travel services, be it the owners, guides, employees, representatives, agents, suppliers or other persons contracted by Earthstompers.
7. I acknowledge that Earthstompers collects and stores personal information such as my name, passport number, and contact information in order to deliver travel I consent that some of my personal information will be shared with the overnight accommodations, suppliers, and the activity providers which form a part of these services. Only the minimum amount of information necessary to deliver travel services will be collected and shared.
